Rules before rescue
Yes Bank judgment underlines why financial stability cannot come at the expense of legal certainty

The Supreme Court’s decision to uphold the quashing of the Rs 8,415-crore write-off of Yes Bank’s Additional Tier 1 (AT1) bonds raises questions beyond affected investors. The fundamental principle is that the urgency of rescuing a troubled bank cannot override the legal framework governing that rescue. AT1 bonds are designed to absorb losses when banks face severe financial stress. Their holders accept higher risks in exchange for higher returns and cannot claim the protection available to depositors.
