Evasion must be penalised, but a 12-year look-back demand must rest on evidence and statutory limits

The Rs 11,526-crore customs duty demand against Škoda Auto Volkswagen India raises questions that go well beyond the classification of imported automobile components. At the heart of the dispute is the tax department’s allegation that the company split imports of components that should have been treated as completely knocked-down (CKD) kits, to pay lower customs duty. If established, such a practice would amount to circumventing the prescribed duty structure and must invite action.
